States are expected to regulate Construction Projects aggressively in 2013

Many states during the upcoming year will be working on new stormwater permitting requirements for construction projects.  The Clean Water Act requires states or the U.S. Environmental Protection Agency to develop new standards for management of run-off and storm water at both residential and commercial construction sites. 

 The Minnesota Pollution Control Agency has started holding what they call stakeholder meetings to help in the development of these standards.  MPCA will be using a general permitting approach to try to cover all projects, but certain individual projects will require individual site permits.  For more information, contact Halleland Habicht attorney Dan Schleck (will link).
